These notices apply to the ShoppingList application for iOS (the "Application"), published by OffByOne ("OffByOne").

1.1 The nutritional grade, ingredient assessments and blood pressure factors presented by the Application are provided for general informational purposes only. They do not constitute medical, nutritional, dietary or other professional advice, and no reliance should be placed upon them.
1.2 The Application is not a medical device and is not intended to diagnose, treat, cure, mitigate or prevent any disease or condition.
1.3 Any user who has a medical condition, is undergoing treatment, takes prescribed medication, or has a food allergy or intolerance must consult a qualified healthcare professional and must rely upon the product packaging rather than upon the Application.
1.4 Nutritional values, ingredient lists and all ratings derived from them originate in a publicly editable third-party database and are not verified by OffByOne. Such information may be inaccurate, incomplete or out of date. The product packaging constitutes the authoritative source in every case.
2.1 Product names, brands, quantities, ingredient lists, nutritional values and photographic images displayed by the Application are obtained from Open Food Facts, a collaborative database maintained by third-party contributors.
2.2 The Open Food Facts database is made available under the Open Database License (ODbL) version 1.0. The individual contents of that database are made available under the Database Contents License (DbCL) version 1.0. Photographic images are made available under the Creative Commons Attribution-ShareAlike licence, version 3.0.
2.3 OffByOne makes no representation or warranty as to the accuracy, completeness or fitness for any purpose of data obtained from those sources.
3.1 Nutri-Score is a registered trade mark of Santé publique France. OffByOne is not affiliated with, endorsed by, sponsored by or certified by Santé publique France or by Open Food Facts.
3.2 Grades displayed by the Application are computed locally on the user's device by reference to the published 2017 algorithm, and may differ from any grade displayed on product packaging.
3.3 All other trade marks, product names and company names referred to in the Application or on this site are the property of their respective owners, and are used for identification purposes only.
4.1 Use of the Application is governed by Apple's Licensed Application End User License Agreement, save to the extent that it is superseded by a bespoke licence agreement supplied with the Application.
4.2 The Application is licensed, not sold.
5.1 To the fullest extent permitted by applicable law, OffByOne accepts no liability for any loss or damage, whether direct, indirect or consequential, arising from use of or reliance upon the Application or the information it presents.
5.2 Nothing in these notices excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which may not lawfully be excluded or limited. Nothing in these notices affects the statutory rights of a consumer.
